Boss gives rubber check they promise to fix, and owes yet another. They're now filing for bankruptcy

I have kept all texts from them. Not two months ago they were avoiding paying me because they "were on a cruise". But now they can't pay us? And they feed me lines of bs, I could care less if it was real or not, I should have been payed A MONTH ago!!! When I told him this is getting ridiculous, he said I was lucky they didn't include the employees when filing for bankruptcy. So, in CA, can you include the employees while filing for bankruptcy and not have to pay them anymore or is he bluffing? And, if I were to take them to court, what charges or whatever would I bring them in on?? Please answer ASAP
