Being denied severance

I have been issued a official lay off letter from Company A, and have been offered a severance package upon departure. The whole department has been outsourced to Company B. Company B wants to hire me and place me on the contract to work at Company A. Now Company A is saying that this is a transition and we are no longer able to pay you a severance package. Is this legal????
