I was terminated by my employer and offered 2 months severance pay if I stayed on 6 weeks and completed a specific list of tasks to prepare my responsibilities to be overtaken by someone else. I asked multiple times to have this in writing, and each time my employer assured me they were working on drafting a severance agreement but explicitly "promised" I would receive the severance as discussed. At the conclusion of the 6 week period, I still had not received anything in writing. I left on good terms, with my employer acknowledging I had satisfactorily completed my departing duties. The severance was to be paid biweekly in 4 equal installments beginning 2 weeks after my last paycheck. I received the first 2 installments, after which point my former employer informed me they declined to pay the remaining 2 installments. I have definitive proof of the oral agreement in the form a recorded conversation. Does this situation fall under the GA statute of limitations for an oral contract (4 years), or the statute governing recovery of wages/overtime/damages (2 years)?
