What breach-of-contract penalties can a for-profit have for independent contractors who are unpaid?

This is in regard to a festival that was founded as a 501c3 and later changed to a for-profit. People who volunteered for the nonprofit are being given a contract calling them independent contractors who are paid $0. The contract includes provisions saying that if these people do not perform all duties specified, such as hours of service, they are in breach of contract and the company can take legal action.
