Owner and practice manager at a business employ their son. Practice manager (mom) alters time sheets to show son working for 40 hours a week,but he does not. Is this stealing from the company, being that they own it? Is this legal in regards to the IRS?

Husband owns a business. His wife is practice manager. Their son is an employee at the establishment. He is a part time employee that rarely clocks in or out. H works about an hour or two per day.. When calling ing payroll, the mom (practice manager) makes up or falsifies hours, so it appears that he is a full time, 40 hour per week employee (although this is not the case). Is this legal, since they own the business? And what about any IRS repercussions or laws? Etc?
