Non-compete clause

I signed a non-compete in around 2004 (Sales position) and was just fired for job performance issues in May 2009. By 2009 the company went through a major merger and they did not ask me to sign another non-compete under the “new” company. I received no money or special benefits by signing the non-compete in 04.

I never knew of any trade secrets or anything like that I was just a typical salesman. My non-compete stated I could not do any business with-in a 250 Mile radius and not work in my industry for 2 yrs. This seems to be very unrealistic.

A few days after being fired I went into business myself and start taking some of my old customers. I am able to offer my customers better service and price for their material.

Can they enforce my non-compete?
