Leaving job due to company's questionable future.

I am resigning from a company that I feel is in a downward spiral and I have felt (with valid reason) that I would be one to soon be let go.

I need to work at some point but need advice on 3 issues......

1. Is a non-compete enforcable if the reason for leaving is to maintain my income,my livelhood and preserve my reputation in the industry?

I have over 20 years expereince in this industry....doesn;t it seem unreasonable that I provide for my family in a brand new industry where I would have to re-establish myself?

2. There is a lot of talk - threat - about the non-compete contract but I do not think they exist. No one corporately has yet to produce one. They were signed long ago and apparently "mis-placed". Doesn;t the employer have to prove that there is such a document with my signature, their signature and some kind of witness signature?

3. I was employeed 2 1/2 years before asked to sign a non-compete. Obviously people sign because of the implication for the future of their employment. Is this enforceable?

4. Are employment laws enforceable from the state your employer is based or the state you reside?
