Is my company required to pay me accrued vacation time upon leaving?

Hi,

I work for a small, privately owned business. I recently put in my 2 weeks notice and was asked to leave at the end of that first week.

Does my employer have to pay me for my unused days? I have a couple weeks of unused time.

There is not written policy in our handbook or elsewhere that states what the company policy is regarding vacation/sick time.

In general there is no statute which covers vacation benefits or payment. If it is not in the manual of the employer, the employer has to have a policy or at least a practice of how accrued vacation is treated at departure or termination. This has been handled in many different ways by different companies. In a smaller company you should know how others were treated, also the owner should at least be accessible to discuss, whether or not the employer wants you around for 2 weeks is not the issue. A calm discussion may get you paid for the days accrued and the 2 weeks.
