Can an employer make you work 80 hours over 2 weeks before you get paid overtime?

I work in corrections in wv. we went from bi monthly payment to bi weekly and they changed there policy so that we don't get any overtime till we reach 80 hours because 1 week we may work 48 hours and the next might be 32 hours. If we work 60 hours in one week and 20 the next we get no Overtime. The flsa act states that anything over 40 hours in a 7 day work week must be paid time and a half. Is this legal?
