I sold a company, but unlawfully told my payroll company that I was still consulting for the new owner, and it was easier if they continued to pay me as before I sold. (Although I wasn't doing any work for new owner - I wanted to purchase a house, and wanted to have the extra income to buy a bigger house)
I never purchased a home - and now I'm needing to correct the 'error'. Because if I don't get under the 12% tax bracket - my CPA says it will cost me about 200k in capital gains from the sale of the business. Can I just send my payroll a check for the incorrect wages I was paid - and then settle the overpaid taxes with the IRS? Can the payroll adjust my W2 to show the correct income? (the Payroll Company told me there is nothing they can do now)
