FMLA Issue regarding Attendence.

I requested Intermittent FMLA for a life long medical issue I have back in September, 6 2009. I found out just 3 days ago, July 22, 2010 that my original request for FMLA was denied. The reason giving was needing more information, or my form was filled out incorrectly. I was told back in Late September, or early October 2009 by a member of HR that it was approved. So I had started to use the FMLA when I had not felt well due to my medical condition.

Now I was told that the FMLA was never approved and that I was told it was incorrectly. In the last 6 months I have used it five times. Since my FMLA was never approved my five absences are going to remain apart of my attendance record at work. At my work once you reach four absences in a rolling six month you get a coaching. I was told today by my employer I am not going to get the coaching since I was told I had an approved absence. But with out another FMLA approved I can not have any type of absence until some absences drop off.

Is it right that they are using those time missed against my current attendance?
