Company Buyout

My husband's job is merging with another company that do not want union drivers, so they were offered a buyout of 2 weeks pay for each year of employment with the company to come out of the union. The current union contract ends in March. Initally the company were supposed to pay the buyout April 1. Now they want to pay it over a period of 4 months & call it a bonus instead of a buyout .Is this legal?
