Employee requested time off due to a fall and injury to her ankle. Doctor has off pending appointment on 5/22. She did not request FMLA but was informed that time off qualified as FMLA. Our policy requires employees to paid any accrued paid time off (vacation) in conjunction with FMLA Leave. She has 2 weeks of accrued paid vacation time. When informed that it qualified as FMLA she said she didn't want FMLA because she has a vacation scheduled in July and didn't want to use up her vacation time. Can she deny FMLA use? Can we count it against her FMLA time if she says she doesn't want it? We are allowed to requirement paid accrued time off in conjunction with FMLA, correct?
