Can an acquiring company hold back a severance package?

The company I work for is being acquired by another. A severance package is promised to employees that are not retained after the merger. The buying company needs many of the employees to stay on for a period of time. They are offering me a retention bonus to stay on, but also will not pay severance until the job end date. Shouldn't the company that I am being severed from pay the severance at the close of the merger? And shouldn't my severance be included on my W2 from them?
