Can I sue the company who didn't pay me until two month later~

I worked as internship in a company in New York City, at the beginning we sign agreement that the company will pay me two thousand dollars for compensation, one is at the beginning of the internship and the other is at the end of my internship in 1st of May. I have been waiting for more than two months, and I call HR, first she lied to me that already sent out, second time she said its on the process, which is the mid of June. Until this moment I haven't receive any notice from anybody within the company! Can I sue the company? I am frustrated day by day coz I worked very hard for the company during the time I was there, and in the end, they just breach their agreement. Thank you very much for your reply!

Ms. Pastor has it right - there is no need to sue anyone. Simply call the EEOC or Department of Labor in your area and they will get you paid. It's not just a breach of their agreement with you, it is unlawful to withhold your income for any length of time so they are in big trouble. If you want to get paid instantly, tell your former employer they have 2 days to issue you a check before the Department of Labor is notified and trust me, the DOL will investigate the entire company if they are alerted to this practice. It won't be good for anyone. Good luck.

If you still have not been paid, you can certainly file a complaint with Small Claims Court or you can contact the Department of Labor and file a wage claim. The Labor Dept will assist you in recovering your wages. Best of luck to you.
