Am I still entitled to FMLA and use of sick leave during my 4 week notice period?

I submitted my 4 week notice of resignation, but will need to use a couple of days of sick leave to care for my spouse before the 4 weeks is up. I am eligible for FMLA based on length of employment, and total hours worked. Also MN law requires employers to allow use of sick leave for qualifying family members in the same manner as for the self. I'm concerned because since submitting the notice I've been treated with suspicion and hostility. Can the employer deny this leave because I am resigning?
