A two week notice of resignation was given to the employer. According to the handbook the employer will keep 40% of the employee's vacation time because they require a one month notice. Is this legal?

60 hours of vacation have been accrued. Handbook states if one month is not given upon resignation the company will only payout 60% of accrued vacation. Is this legal? I have never heard of such a situation.
