From July 2014-July 2015 I had an open FMLA in which I missed a total of 2 days. I have had 2 days that were miss handled and one denied that i am still tring to get them to fix. Recently I missed a day of work not related to the FMLA on 12/14. I received a home visit from a deputy fire chief to see if I was home. This has never been done in the last 7-8 years. I have missed a total of 3 non-fmla day in 2 full years. Although allowed by contract all it says is "the employer shall continue its practice of not commonly calling or visiting the homes of absent employees". It also states that patterns of absenteeism can lead to discipline up to and including termination. The 3 non-fmla days show no pattern of abuse. To me it seems like they are harrahing me because of the FMLA usage this year to establish a pattern. Although nothing has offically been said. They still have not fixed the fmla days in the system we use and have attempted to give me letters of accumulation for days I was on fmla. Does the home visit fit under fmla retaliation? no other employee have been treated in the same fashion.
