I live in nevada which has both a +40hr weekly plus a +8hr daily overtime pay law unless exempt which from what ive researched i am not (stylist/cosmetologist at a franchise paid hourly) but one law i cannot get an answer on is the exemption for working for "enterprises earning less than $250,000 annual gross income" first off i work at a "chain salon/franchisee owned" but i do not for the corporation,i am paid by the franchise owner so how would i find out accurate information on the annual gross income of the franchisees llc. which pays me & is it off the franchise owner or the corporations which will decide if i am exempt under that clause. Second i do get paid overtime when i work more than 40 hrs in a week &8 hrs in a day but i recently realized that they only pay overtime for "floor hours" so "non floor hours"dont count towards overtime, i get "non floor hours" when i switch my clocked in status from "stylist" to either "non stylist"-used for meetings or "closing"-used when the salon closes but i am still there cleaning&closing the register/handling money&bank deposit. I was told to switch to these other options to keep my productivity from decreasing since i will have no customers at those times, but i am still working in my salon sometimes 1 hour more. Is it legal for them to not count these hours towards overtime. I was never given or signed any wage agreement but just 2 days ago saw paperwork regarding wages in the office that is being given to new hires,this packet states that 'vacation days, sick pay,holiday pay,administrative & non floor hours do not count towards overtime pay". I've been researching nevada revised statute & nevada administrative code regarding these issues so when i confront them i will be informed but im worried they might be exempt from these rules because they gross less than $250,000 annually,the franchise owners company is private &i cannot find any information regarding finances so i dont know how to get this answered &if i ask my job i figure they'll lie or not tell me. I plan to ask for a record of my hours&wages since start of my employment to see how many "non floor"hours weren't counted into my overtime hours. On another note they do not have any postings regarding fmla,ada,minimum wage osha,polygraph testing, overtime law or anything other than some printout thing they filled in saying we get paid bi-weekly that was posted last month. I have a form to fill out titled "documentation" from my job i planned on using when requesting my hours&wages info, should i also fill one out&make a formal complaint to them regarding the lack of required posted notices or just report it to the labor board? I also do not ever get the amount of breaks i deserve under law & i have been documenting that as well. I am sorry to ask so much but I've tried to find answers on my own but have hit a wall, the most important question i think is how do i find out the gross annual income & is it the franchise owners company which is on my paychecks (an llc) or the corporation whos name we're operating under ,which ones annual gross income/profits(not sure) will decide if i am exempt or not?
