Answer to Can an employer make an employee sign a non-compete when they resign? There was never one in place during her employment or as a term of employment.

No, the employee cannot be required to sign a non-compete.

Answer to Employee took vacation, HR paid their full wages. Is there a way to recoup the 3 days from employee?

From the plaintiff's side of things, better to let the employee know what happened and find a solution together. You're asking for trouble if you dock a paycheck.

Answer to My employer terminated me wrongfully in January and I asked for a review board. The review board deemed it necessary to reinstate me. The business unit wants to bring me back at 65% of my salary. Is that fair?

Best to speak with an employment lawyer because more information is needed. You can find great employment lawyers here on MEL.

Answer to Non Complete Agreement w/non disclosure of important information

Interesting question. Short answer is that consideration for the non-compete is continued employment. There might have been a failure of consideration (continued employment) rendering the non-compete invalid. Situation also gives rise to potential fraud/misrepresentation claims/defenses.
