It is always a negotiable item. You might try asking for an interview with the top HR person, and tell them you will need to go on worker's comp stress unless they help you out with this. It might work.
Other than being a bad manager, do you feel you are being "constructively discharged" because of something illegal going on, or against public policy, or some form of discrimination, retaliation or harassment? If so, then there might be something more involved.

It's a classic rip-off.

There are many cases on the books about this type of matter. While they are not always a slam dunk, the gut reaction is this is terribly wrong. And there is a lot of legal support for that.

California in particular has some very good laws in this area for the employee. There is a law that specifically makes it illegal to make someone relocate on a false promise.

There looks like a good chance you have a case, but it needs more information to tell for sure, and what kind of case it might be.

Do you work for a private company, or the government?

Were you complaining about your own paycheck, or what was going on in general?

Either way, you may have a "whistleblower" type of case....there are different laws involved, but the basic idea applies pretty much the same to private companies as the government: they can't retaliate against someone who complains the law is not being followed.

It is important for you to be very proactive now if you want to protect yourself....all possible favorable witnesses must be contacted right away before memories fade or change. Also, keep tight hold on all important documents.

Dear Kathleen:

Looks like a classic set up.
Setting you up to fail is one of the most used tricks to cover up the real intent of getting rid of someone for an illegal reason.

I have seen this type of underhanded dealing with women before.....with all the laws that have been enacted to stop this it is still amazing that it keeps going on.

It is important to be very proactive at this point, by consulting with a good lawyer who can get an investigation going right away. In cases like this people who will help support your story are a key factor...they may talk and support you now, but as time goes by.....who knows?

You also mentioned age discrimination...is that really a factor, or are you just suspicious?

Yes, Tom, it seems that you have the start of a good age discrimination case.

This is a scenario I have often seen before. When they start the new younger employee, they have already made the decision to let the older employee, who costs more for salary and benefits, go. Then they come up with a sudden excuse they have to cut costs.

I have often proved this from the company's own records, the offers made to the new employee, and the new employee's testimony about why they were hired.

In cases like this, the best evidence often "disappears" quickly...documents are lost, memories change, etc. A very fast and aggressive immediate investigation is crucial.

I don't see where discrimination fits in from your description.....but no doubt there are a lot of additional facts.

You very may be a discrimination victim....but it's hard to tell straight off from what you wrote.

It is not that hard to get to "first base"....you need to show that you were qualified, doing a proper job, and then were replaced by a male. Then the harder part comes in...your employer tries to come up with a bona fide business reason for the change, and you try to show it was just a pretext for the discrimination.

What really sets off just a techincal case from a solid one is any open or overt discriminatory animus....hostility, etc., or a pattern of similar conduct....how well represented are women in management? What sex were the decision makers.

Most helpful of all...what is your get feeling, and that of other women at the company....is the "glass ceiling" obvious for all to see?

Whew! Quite a story.

If I am not summarizing too much, it sounds like retaliation at the first office and "reverse discrimination" at the second office. Was this all while working for L.A County?

Regarding the "Strand" lady. it's unclear what the retaliation is for, or if it would support a case. Being a major bitch does not make a case by itself....the retaliation has to be against some law or strong public policy. Was it because the lied about the ot, or because of the jury duty, or becuse of your lawsuit? If it was, there may be something there to go on.

Race discrimination is illegal, no matter who does it to whom. Years ago in Chicago I had a similar case involving the secretary (white/jewish) of Chicago Mayor Jane Byrne (white) who stayed after Harold Washington (Chicago's first black Mayor) was elected. A similar story to what you describer above.
