You might be able to defend on that basis. Depending upon the language of the Agreement, there may also be other defenses you may have. You should formally consult with legal counsel on these issues and let him/her review the non-compete.

Overtime Question

She needs to address the issue with employer in writing and possibly the Department of Labor. If they retaliate against her, that is a violation of law. She may also have a claim against the employer for unpaid overtime. Feel free to call me with questions.

Sounds like she might have a claim for discrimination. She would first need to file a charge with the EEOC or Fla Commission on Human Rights. Call me if you want more help and want to talk about these issues.

I would need to see the non-compete, I would think that the geographic scope that they are seeking to enforce is too broad. I would need to know more about the business and your former job.

I believe I just read some cases that say that you can't recover these under a Florida Whistleblower Claim. I would have to research if further to give you a firm answer.
