You should consult with a competent employment or civil rights lawyer IMMEDIATELY. If you were fired less than 3 years ago, you may still be able to bring a NYS HRL claim or a Sec 1981 claim. Some lawyers offer a free initial consultation.

Without giving legal advice, on its face this employer seems to be refusing an employee a benefit of employment on account of her gender. She should consider filing a charge of discrimination with the US EEOC (NY District Office), NYS DHR, or City CHR. There is, however, always the risk of (unlawful) reprisal by the employer.

Answer to Unfair treatment and layoff

A wise rule is not to date subordinates. Sometimes human nature gets in the way.
Can a lawyer help a person who makes a mistake or indiscretion? It all depends on the individual facts. It's tough for a person in an "at will" state such as New York. But sometimes companies use mistakes as a pretext, in order to take unlawful (discriminatory) action. Then there may be a remedy.
