Questions for you:

1.) Do you have a written employment contract? If yes, an attorney needs to read it.

2.) Any witnesses or emails, etc that prove the firing was for asking to be paid on time.?

3.) How big is the company?

4. ) where you ever not paid overtime or did they deduct for time that you actually worked?

Also, you could possibly file for your owed check and/or unemployment with the Texas Workforce Commission. You can file over the phone or on-line.

Answer to My employer asked me to take a lateral move from Director of Business Development to Director of Admissions. I declined and tendered my resignation with 30 day notice. They have already filled the Director of Bus Dev position so in what capacity do I have

I would need to know a bit more information.
First and importantly,did you have a written contract of employment?
Not speaking directly to your facts, but here is short answer on Texas law:
Absent a written contract Texas is generally an "Employment At Will "state. Basically, that means that the employer or the employee may terminate the work relationship at any time, for any reason.
In Texas, (and under some Federal statutes) a unilateral right to terminate is limited by several exceptions such as Whistleblower, discharge because of race, disability, color, religion, national origin, age or sex to name a few.

On the limited facts presented I would want more information on the issue of discharge vs. voluntary resignation.
