You are being treated differently because you ARE a different category of employee.
Different requirements are expected from Exempt as opposed to non-exempt employees. For one, you are paid overtime pay for all hours over 40 worked in a work-week. Exempt employees do not realize that additional pay benefit. Thus, you can be expected to be treated different as to time attendance requirements which is perfectly legal, under both Maryland and Federal law.

A lot more information is required to give an intelligent answer, for one, what is your "field"? Generally, any non-compete must have a geographic limitation as well and that limitation must be reasonable.

Answer to MANDITORY OVERTIME

An employer can require a person to work overtime as a condition of employment. Every employee is entitled to at least one day off per week. If you work more than 40 hours per week, the employer is required to pay an overtime wage of 1.5 times your normal rate for every hour worked.
