Answer to I work in Washington state. My employer wants me to sign a paper stating that i will not file for unemployment. Can they do this?

It is difficult to imagine a context where such a request would be viewed as appropriate. If any action is taken with respect to your employment for failing to agree to that, you should seek legal counsel immediately.

Answer to Are contractors entitled to severance?

Severance payments are arranged by contract between the parties, and there is almost never an obligation to provide to severance to either an employee or independent contractor. Severance payments are usually accompanied by some sort of release of potential claims by the person receiving severance, and that is usually the primary motivation for employers to offer severance at the end of employment. You should certainly consult any written agreements that you have with this contractor concerning any obligation that you might have in this instance.

Answer to Is my employer required to pay residual commission while on FMLA leave?

If the commissions are for amounts earned while working, I believe that you would be entitled to be paid for those amounts. You should, however, obtain legal advice regarding the specifics of your situation.

Answer to harassment

Response

Thank you for your question. You could have a possible claim of defamation against the owner, but before pursuing a claim, you would want to know what actual harm (i.e. lost employment opportunities, lost income, etc.) you have suffered as a result of any false statements. Also, if you have witnesses that can testify that their opinion of you has changed as a result of those statements, that can be supportive of a defamation claim as well. If you gather that type of information, and want to consult about that, I would be happy to speak with you about your options.
