Last Paycheck

Your employer is not standing on any valid legal grounds. Even in Georgia, you would have the right to get that paycheck, and possibly even attorney fees. However, you need to determine whether in your circumstances a legal action would cost you a good recommendation in the future. If so, handle it cooperatively. In any event, a single letter from an attorney will get you your paycheck very quickly. They have no right to hold it up.

I would recommend you call a lawyer in your area that specialized in social security disability applications and benefits. many of them work on a contingency fee basis. Also, why did you not mention an application for workers compensation benefits. That should have been an automatic. I hope that you have already consulted with a workers comp attorney.

Harassment

Under Title 7, Employers may not discriminate or harass an employee on the basis of race, sex, religion, or national origin. Evidence of discrimination or harassment may be direct such as a racial epithet, or indirect. You need to really examine whether you believe you are being harassed or discriminates against becuase of your sex, race, religion, ethnicity or national origin. Are there witnesses who would testify on your behalf. Ask what would they say? If you believe you are being illegally discriminated against, you need to tell your supervisor or H/R and give your employer an opportunity to investigate and fix the situation. Of course, I would recommend a one on one consultation with an attorney in your city immediately before you take any action. Good Luck to you. Again I reiterate - consult an attorney in person - do not simply rely on what I have written - it is no substitute for a real individual consultation.

Physiian non-competes, under Georgia law, receive a middle level of scruitiny, and, depending on the acutal language - though you raise an interesting point that you never signed the new agreement, though you operate under it for the purpose of remuneration and benefits. I have done a large number of physican non-competes and would not be comfortable rendering advice outside a meeting in my office with both employment agreements there to review in detail.
